Terms and Conditions of Sale
These Terms and Conditions (“Terms”) govern the purchase of any ready-made artwork (“Artwork”) from Annatomix (“Artist”, “we”, “us”, “our”) by a buyer (“Buyer”, “you”). By purchasing an Artwork, you agree to be bound by these Terms.
- Final Sale and Non-Refundable Policy
All Sales Are Final: Every piece of Artwork is unique and sold as-is. Once a purchase is completed and payment is processed, the sale is final.
No Change-of-Mind Refunds: We do not accept returns, cancellations, or exchanges, and we do not issue refunds if you change your mind, find that the piece does not suit your space, or decide against the purchase after payment.
- Digital Representation and Colour Accuracy
Screen Variations: While every effort is made to photograph and document the Artwork accurately, minor variations in colour, contrast, and texture may occur due to digital screen calibrations, lighting conditions, and device settings.
Exclusion: Minor variations between the digital image on a screen and the physical Artwork in person do not constitute a defect or a basis for a refund.
- Payment and Ownership
Full Payment Required: Full payment must be cleared before the Artwork is packed, shipped, or released for collection.
Title Transfer: Ownership of the physical Artwork passes to the Buyer only when full payment has been successfully received.
- Shipping, Delivery, and Inspection
Shipping Responsibility: Artworks are packed securely and shipped using reputable courier services. Estimated delivery dates are non-binding.
Immediate Inspection: The Buyer must inspect the package and the Artwork immediately upon delivery.
Damaged in Transit: If an Artwork arrives genuinely damaged due to transit, you must notify the Artist via the contact page, or by replying to your purchase order within 3 days of delivery. Your email must include:
- High-resolution photographs of the damaged shipping box/packaging.
- High-resolution photographs of the damage to the Artwork itself.
Resolution: Valid claims reported within the 3-day window will be assessed for courier insurance. The Artist will work with you in good faith to resolve the issue, which may include a professional repair, a store credit, or a refund at the Artist’s sole discretion. Claims made after 3 days will not be accepted.
- Intellectual Property and Copyright
Retention of Rights: The purchase of the Artwork transfers ownership of the physical object only.
No Commercial Rights: The Artist retains 100% of all copyrights, reproduction rights, and intellectual property rights associated with the Artwork. The Buyer may not replicate, scan, create prints of, or commercially exploit the image of the Artwork without explicit, written legal consent from the Artist.
- Statutory Consumer Rights
Nothing in these Terms is intended to limit or exclude any statutory rights you may hold under applicable local consumer laws that cannot legally be waived.
- Governing Law
These Terms and any disputes arising out of the sale of the Artwork shall be governed by and construed in accordance with the laws of England and Wales.
